i had an accident?
yesterday just to find out when i got home and called to make my claim to insurance agency that they cancelled because they had the wrong phone number... so i called the other person involved and asked them to please let me resolve this between us cause I am in school and working and cant afford to lose my license well they were driving a honda civic hybrid and all that happened was a llil of my paint from my license plate rubbed off on their bumper and now when i talked to them they said they had an estimate done and it is gonna be 799.00 Because of the kind of car it is !!! that they have to replace the bumper cover and the mud flaps and i dont know what else and that they got whiplash but yet they didnt get medical attention at the scene?? am i liable for this or would they had to have got help right away ?? please help thank you all
If they find out you have no insurance, they will most likely drop the whiplash claim. If they're using an attorney, the attorney will no longer represent them because they only want to deal with cases where insurance is available to pay big bucks.
As for whether or not they can claim whiplash a day later or weeks later, yes they can. Actually you often don't notice neck pain until the day after.
As for the bumper, it can be fixed rather than replaced. But the car owner / insurance company has the right to decide whether they want the bumper cover replaced or repaired. The'll often claim that there's damage to the material behind the bumper cover, that it would be unsafe to re-use material that has already been involved in an accident.
You won't lose your license unless they got the police or DMV involved.
Since you have no insurance and no money. They have to live with collecting from you and livign with what and how you can afford to pay them. Depending on the insurance, their insurance company may decide to take care of the claim in advance and collect later form you. But for small amounts, insurance companies often don't bother with too much effort and wrie it off as a loss. But if insurance gets involved, the DMV will most likely be involved as well. Then, loss of license.
